Friendlore Terms of Use

In short


1. Who are we and what are these terms about?

1.1 Friendlore is an app in which you can create events, invite people, let people know you are going somewhere, follow other users and share photos ("moments") of events. The app is offered by Ruud van Zwieten, Loenen aan de Vecht ("we").

1.2 These terms apply to everyone who has an account on Friendlore ("you"). By creating an account and agreeing, you enter into an agreement with us.

1.3 Our privacy policy (https://friendlore.app/en/privacy) explains how we handle your data.

2. Who may use Friendlore?

2.1 You must be at least 13 years old. We ask for your date of birth when you sign up. Fill it in honestly. If you are under 16, your account is private, and you can only make it public once you are 16.

2.2 You may have one personal account. Use a name that fits you. You may not pretend to be someone else, or an organization you do not represent.

2.3 You may not use Friendlore if we have permanently banned your account before, unless we explicitly allow it.

3. Your account

3.1 Keep your password secret. You are responsible for what happens with your account. Do you think someone else can get into your account? Then change your password and let us know.

3.2 You can delete your account at any time, in the app (Settings → Delete account) or through https://friendlore.app/en/delete-account. What then happens to your data is in the privacy policy.

4. What you can do with Friendlore

4.1 You can create a profile, follow others, create and share events, invite people, say whether you are going to an event, post moments, comment, like, block other users and report content.

4.2 Friendlore is free. There are no ads and no tickets are sold.

4.3 We update the app regularly. Features may change, be added or disappear. If we remove something that matters to you, we tell you in advance when that is reasonably possible.

5. Your content

5.1 Everything you post on Friendlore, such as your profile, events, photos, captions, comments and updates, we call "content". Your content stays yours.

5.2 To make the app work, you give us permission (a licence) to store your content, adapt it for display (for example making a photo smaller) and show it to the people allowed to see it under your settings. This licence is free, non-exclusive, and only applies to providing Friendlore. We do not use your content for advertising and we do not sell it.

5.3 The licence ends when you delete the content or your account. There are two exceptions:

5.4 You may only post content that is yours, or that you have permission for. If you post a photo in which others can be recognized, make sure they do not object. Recognizable people have portrait rights.

5.5 You are responsible for your content. We do not check everything in advance.

6. House rules: what is not allowed?

On Friendlore you may not:

  1. post or organize anything that is illegal, or call for something illegal;
  2. threaten, intimidate, bully or harass others, also not through invitations, tags or comments;
  3. spread hate or discriminate against people because of, for example, origin, religion, gender, sexual orientation, disability or age;
  4. glorify violence or call for violence, or post something about self-harm or suicide that may encourage others;
  5. post nude or sexual content. Anything in which minors are approached or depicted sexually is absolutely forbidden, and we always report it to the police;
  6. share other people's personal data without their consent, such as an address, phone number or other private photos;
  7. post fake events, scams or spam, for example an event that does not exist, or an event that only aims to make people pay money or lure them to another website;
  8. pretend to be someone else, or use several accounts to get around rules;
  9. infringe other people's rights, such as copyright and portrait rights;
  10. misuse the app: for example automatically (with scripts or bots) creating accounts, sending messages or collecting data, trying to get around the security, or overloading the app.

Organizing an event? Then you are responsible for your event: that the information is correct, that it is safe, and that you follow the law (for example permits and rules for alcohol). We do not organize events and are not a party to arrangements between organizers and guests. Going to an event of someone you do not know? Be careful, as with any meeting with strangers.

7. Reporting

7.1 See something on Friendlore that is not allowed? Report it. In the app you can report a profile, event, organizer update, moment or comment through the menu (…). Choose a reason and add an explanation if you like.

7.2 No account? You can also report illegal content through https://friendlore.app/en/report or by email to contact@friendlore.app. Please include:

7.3 You get a confirmation that we received your report. We assess every report carefully, and we tell you what we decided. The person you report does not hear from us who made the report.

7.4 Do not make reports you know are not true. If you do that often, we may stop handling your reports for a while.

8. What we can do (moderation)

8.1 We look at reports, and sometimes on our own initiative at content, to check that everything follows these terms and the law. People do this, not a computer. Automatic limits (for example how many events you can create per hour) are only there to prevent spam and abuse.

8.2 If something breaks the law or these terms, we can:

8.3 We choose a measure that fits how serious the violation is. Usually it works like this:

For serious violations, such as threats, sexual content involving minors, spreading someone's personal data or scams, we can ban your account straight away.

8.4 Explanation. If we take a measure against you or your content, you get a message from us in the app and by email. It says:

8.5 If, based on information, we suspect that someone's life or safety is in danger because of a criminal offence, we report it to the police at once.

9. Appeals

9.1 Do you disagree with a decision about your content or your account, or with our decision about something you reported? Then you can appeal within 6 months. Use the "Appeal" link in our message, or email privacy@friendlore.app. Explain why you disagree.

9.2 Someone other than the person who took the first decision looks at your appeal again (when possible). You get a reasoned answer within [14] days. If we were wrong, we reverse the decision: we restore your content and lift a restriction.

9.3 You can also always go to court.

10. Ending

10.1 You can stop at any time by deleting your account.

10.2 We can end the agreement by permanently banning your account, as described in section 8. If we stop Friendlore altogether, we tell you at least [30] days in advance, so you can request your data.

11. Availability and liability

11.1 We do our best to make Friendlore work well and safely, but we cannot promise that the app is always available or works without errors. Make sure you also have important information, such as an event's address, somewhere else.

11.2 We are not liable for:

This does not apply if the damage results from our intent or deliberate recklessness, nor where the law forbids us to exclude liability. [TODO lawyer: word a limitation that fits consumer law (Article 6:237(f) of the Dutch Civil Code).]

11.3 You are responsible for damage caused by not following these terms or the law. If someone files a claim with us about that, we may ask you to help us handle it.

12. Changes to these terms

12.1 We may change these terms, for example because the app changes, because the law changes, or to fight abuse better.

12.2 For a change we tell you at least 30 days in advance, in the app and by email. We tell you what changes. Small improvements that change nothing for you, such as a typo or a new address, we make without a new version.

12.3 From the date the new terms apply, the app asks you to agree again. Until you have done so, you can still sign in, look around, request your data and delete your account, but not post anything or join.

12.4 Do you not agree with the new terms? Then you can delete your account. This costs nothing.

13. Contact (DSA points of contact)

13.1 For users: you can reach us at contact@friendlore.app. You get an answer from a human, not only from an automatic system.

13.2 For authorities (such as regulators, police and the courts, the European Commission and the Digital Services Coordinator): privacy@friendlore.app.

13.3 You can write to us in Dutch or English.

14. Applicable law

14.1 Dutch law applies to these terms. If you live in another EU country, you keep the protection that country's consumer law gives you.

14.2 You can bring a dispute before the court that has jurisdiction under the law. As a consumer you can also go to the court where you live.

15. Other

15.1 If a provision of these terms is invalid, the other provisions still apply. We then replace the invalid provision with one that comes as close as possible to its intent.
